Ripoff harassing my fiance

Lucky for me I do not have a credit card from Aspire. My fiance does, but it was under Providian before Apire acquired his account.

After the birth of our daughter in January, he has fallen a bit behind on his account. Things got worse when his car broke down and had to pay $2000 to fix it. He fell further behind.

First Aspire started with the reminder notices each time he was late. Then, because he didn't pay at all since he was trying to get debt consolidation they started with the calls. They call at least 5 times a day, and I swear 7 day a week. They have called him at work after he has said that his employer forbids the calls. They have tried their best to get his bank info to set up payments, but after reading this site, he is afraid that they'd try to charge the full balance. He stills wants debt consolidation, but fears that Aspire will reject any offers at this point.

I went to the Federal Trade Commission web page and read the Fair Debt Collection Practices Act. Section 805 states that these people are not supposed to call your place of employment if they know, or you have told them that your employer does not permit it. (Those are not the exact words, but that is the gist of it. Can't Aspire be sued for violating the FDCPA?

My fiance needs to pay, no doubt about that, but since he has gotten all the calls, he is getting angry and wants to take action. If there is anyone that has been successful in filing some type of complaint, suit, or cease and desist please let me know.
I have my own debts or I'd be helping with the bill. It has gotten so ridiculous and out of hand. I want to help him resolve it.

Thanks to the complaint site and everyone that has told their stories. The info we have read here is giving us the confidence to take this a step further instead of taking the abuse.
