V.I. P Travel Club Time share rip off

Tres Rios hacienda is a rip off. If you are reading this message it probably means you to are victim. My story is like many others. We were approached by someone at the air port in Mexico with the promise of free tickets to attractions. Once we arrived at the resort for the ninety minute presentation we were pressured into buying their resort. We finally said no. (You must realize that they take you way out of town and down dirt roads till you have no idea where you are at. Our cell phones didn't work in Mexico so you are relying on them to take you back!) We were then taken into a room and introduce to the owners Nephew of the resort. Who then made us a 20 week vacation package offer which we decided to take. Thinking that we could cancel the contract with in 5 business days. But here is catch. The language reads as follows:

Clause 12 of the membership agreement:
The Member may accelerate termination of this contract with the consequent refund of amounts paid within 15 calendar days, provided he/she gives written notice to the club at it's domicile, that of it's representative, or that where this operation was executed, and within five business days, counted from and after the business day following signature of the contract. If the accelerated termination made out side the term, the CLUB shall retain the amounts paid thereby as contractual penalty.

Clause 13 of the membership agreement
The member acknowledges that the only cause for rescission of this contract would be 1) failure to pay the annual dues in a timely manner or 2) in some form misuse the VIP TRAVEL package and in either case the CLUB would have no obligation to refund any money and would be held harmless from any possible legal action.

When we asked about clause 13 they said it was the only reasons they had to cancel us. However, then they use it to say you signed your right to cancel away!

They seem to ignore the clause that says you have five days to cancel, but point out that the only "Cause for rescission of this contract" is the two they state.in which again you lose your money.

When you get back you will notice there is no mailing address. Most of the Phone numbers will disconnect you when you are transferred to "Customer service"
We immediately put the charges in dispute with the credit card.
We were able to send a fax and an E-mail on the third business day and we got a call from someone on the fourth day. I told him we wanted to cancel the contract and he said we had signed away that right. But he didn't want to argue and gave me a case no. Said he would call me the next day to let me know when I would get my money back. Even after a follow up call by me two days later I have not been contacted by anyone. We are going to try some of Mexico's agencies suggested by people from these posting of RIP OFF REPORTS and others. If anyone has had success in getting their money returned. Please make a post and let us know how we can do it also.
