Sales people lied about inventory to make the sale

We recently went to a sales pitch by Spinnaker resorts at Waterside. We had a fixed week time share in Sept. But no longer could use it that week. We told the sales staff that we wanted a June week. They insisted the new"flex time" week was the way to go, that we would have a 99.9% chance of getting any summer week we wanted (except the 4th of July) with no trouble. The flex week was $10k in addition to the $14k we had bought our fixed week with. We told them that was a huge financial stretch for us.

Not only did the salesman, but then the sales manager all told us it would be 99.9% chance we would always get the summer week we wanted. Our 12 year old with us also heard these claims. We bought. The following June, we put in our request at the earliest possible moment anyone could - within a minute past midnight 360 days in advance. And we did not get the week.

The reservation dept. Later told me we would NEVER get a June week, and likely have great difficulty getting ANY summer week as there was NO June inventory and very little summer inventory. We were clearly sold under fraudulent pretenses. If there is no inventory and we can never get a June week, we were lied to. Upon speaking with another employee for Spinnaker (out of Branson, MO) we were informed this is a common complaint and many Waterside owners of flex time have been lied to and been unable to get summer weeks. I think there is the potential of a class action suit and would strongly encourage people to not buy at Waterside.
