Board of Directors Attempt to evict family from titled easement to Crystal Lake

January 7 Lackawanna County Court House, Judge Nealon, Elkview Country Club Council and Malinchak 18 year lawsuit was settled. After 18 years of continuous family disruption by Elkview membership, directors and council it has been determined that an easement of ingress, egress and regress to Crystal Lake across lands of Elkview Country Club is IN DEED a valid access to the watershed AKA Crystal Lake.
"It is further agreed that the rights of all parties that were subject of these two litigations shall continue in full force and effect as they existed in 1993 before the commencement of either action"." It is confirmed that, Thomas and Diane Malinchak for themselves, their heirs and assigns agree to exercise their rights of access to Crystal Lake at the site known as and designated as the Middle Launch".

After the settlement, Thomas J. Malinchak, Sr. Was guaranteed re-entry into the Elkview Country Club and was approved by the board of directors. Country Club Council advised Malinchak to submitt an application for membership and the following response/letter was received:

We regret to inform you that after review of your application for membership to Elkview Country Club at the December 16 board meeting, we can not accept your application for Senior membership based upon our bylaws and the actions taken by a previous Board of Directors on july 7,1993.
