Verbal contracts: Managers condone conniving behavio

I am a college student and there were free 3-day passes to club fitness being passed around school advertising their gym. My friend and I decided to try it out and we were definitely in for a surprise. We were told if we forfeited our 3 day pass and signed up that day they would waive a $199 fee and give us a student discount.
This idea sounded great and we decided to talk to him about it.

I am not from the town I go to school in and did not want to sign a contract because I will be graduating soon and no longer be here. We told the employee that we could not sign a 2 yr contract for that reason. He proceeded to tell us that we could cancel any time with in the first year, which sounded great.

When I later tried to cancel he told me that I had to cancel within the first 12 days... REALLY? Now I have a collection agency calling me all hours of the day and night and they are asking for well over $1000 plus attorney fees. When this was the exact reason we told him we could not sign up in the first place.

Not only did he lie about the contract, but asked if my friend could put her account on mine because she did not have her information that day and it would be void if she came in the next. This was not a problem but I asked that it only come one time and he assured me that it would only come out the first month. She had to bring her information in and everything would be switched over.

About a week later she took the information up there to get switched over to her account and he told her just to run it through my account, failing to mention this to me. This laziness has caused me alot of unnecessary problems and stress and the managers do nothing about it. I tried to get a copy of my contract today and had the cops called on me... And for what? I was not disrespectful or loud but this is a horrible way to run business.

I would strongly recommend that you find a gym that is not trying to find sneaky ways to get money. They charge late fees on money that is drafted out of accounts monthy. How do you have a late fee if they draft the money? The funds were available and exceeding the necessary amount but they still charge late fees. This is a horrible way to run a business and they will do it to anyone... Find a better gym!
