Paramount Acceptance Hurricane Katrina, taking money out of my account for a gym that was not even available

I had joined French Riviera Spa only because of the trainer I was provided if I did sign. He was the only person there who was at all friendly and he did a good job. I was treated from the start very poorly, however things didn't reach the boiling point level until Sept. As you are aware I'm sure Hurricane Katrina happened Aug 29th of the Gym was destroyed. I contacted French Riviera Spa to find out why they were taking money out of my account even though the location was not operational. They informed me that they would put it on freeze and credit back what had been taken, which at that point was only 1 month.in October they took money out again and I called again they told me the same song and dance yet continued taking money out until I believe Dec.

In their own contract it clearly states that if that Gym is not operational for 4 months or more the contract is void. The Gym was not re-opened until Jan 15th and even then it was a very poor attempt at a gym. I had literally been working on this with them for over 4 months and was hung up on, yelled at, told they didn't have a regional or district managers number and no Corp number as well. This seems odd since they are a part of a Corp, I had to search through out the internet to try and find a phone number that worked and that went to the actual Crop head quarters.

When I finally did get through I was told it would be taken care of, that they would call me back etc. No one ever called me back, I decided that I would proceed on getting a lawyer. I did and he sent them a letter which stated what their contract said, what the law was and that the contract was void and I owed them nothing, especially considering the gym was not even operational until Jan 15th.

I never heard back from them about this, no one contacted my lawyer although recently they have told me they "tried" to contact him and it was a wrong number. So over 2 yrs later I receive this letter from Duggins law Firm in LA and it says I owe over 500.00 dollars for something I have not used. It threatens me with collection etc. I have called the numbers left on this letter and have called French Riviera Spa only to A: receive no call back from this Law Firm, and a message from French Riviera Spa saying they don't have my account and I must call Duggins Law Firm. This is gross fraud and harrassment, and I will be taking legal action if this is not resolved in a kind and honorable manner.

In other words be very careful before joining this Gym, they wont even hold up their own agreements/contracts, which is required by the law.
