Charged me for medical records without notification!

I am being charged over $400 for medical records when I never knew/signed for the cost, and this is in a collection agency's hands now.in August of I requested medical records for my child, Braelyn A. Culp.in September of I received the records and found a bill for over $400. At no point was I ever notified of the cost. I understood (with common sense, not notification) that I would pay a fee for records, but I never was notified of the rate per page, nor was I told how many pages were in my daughter's file.

I called HealthPort to dispute the charges. They informed me that it was the hospital's responsibility to inform me of the charges, and that the hospital would have to take care of the charges if it was deemed to be their fault. I then called the hospital. The CSRs at the hospital said it was HealthPort's responsibility to notify the customer of charges.

When I spoke with someone at HealthPort again, they said that they did notify me— when they billed me... Which was WITH the records, not prior to sending them. I've tried several ways to fix this issue, but the only thing they will over me is a 50% reduction to my charges, but this is still well over what I am comfortable with paying for pieces of paper— in excess of $200!!! I explained that I would never have wanted the records if they were going to cost over $20.00, but they seem to be completely incompetent when I ask why no one informed me of the cost.

A year later, I received a notice from Chase Receivables (a collection agency) with regards to this account. They are now saying that I owe $429.98 for these records, and will report to the 3 credit bureaus if I don't pay. According to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b), validation is required& and there is NO validation since they cannot provide any documents that show that I ever agreed to pay ANYTHING, even a dime.
