I'm writing just to encourage people to sue! I stupidly signed a contract w / GE afer a 3 hour "consultation". I realized my mistake after I went home and did some research on the company. I called the next day to cxl and was told NV doesn't have a 3 day right of recession. I'm originally from CA where you do have the right to recesend a contract. I had asked about the 3 day right w / my consultant and was led to believe I had the same right in NV. When I called to cxl and the gloves came off, she told me she was agreeing w / me that CA had a 3 day right of recession, she never said NV did. Slick.

I went ahead and mailed them a letter (certified mail) and canceled. They of course wouldn't give me my money, my credit card company was no help and so I took them to small claims court.

Long story short, I won. I never used their service, I didn't even have a video made. While NV doesn't have a recession law it doesn't recognize a forfiture (spelling is probably wrong). A contract is a meeting of the minds, if one person gets $1000s of dollars and the other person gets nothing, then there was obviously no meeting of the minds. Many states do not recognize forfitures either.

The judge really raked me over the coals, and for a while it looked like I would lose. The tide turned when he asked started asking me about my use of the service. When did I take my pictures? (never) Did I make a video? No. Had I used my membership at all? No. He didn't make a decision that day but 3 weeks later he ruled in my favor and I got every penny back. I did have to pay my own court cost, but they totaled all of $75. It took GE another month to pay me. I was on the verge of filing w / the court to force pmt when the check came.

I would suggest you put your complaint in writing, send it certified mail, and give them a time period to get back to you w / your refund. If they won't do it, sue!

Many people told me I wouldn't win, I was going to have to chalk it up to a lesson learned. Don't Listen! The courts are starting to realize that companies like GE prey upon people and if given the chance I think they will rule in your favor.
