Prom Dress / Floor Model for new

Went to Chic Boutique in February and put a prom dress on layaway for my daughter. I finally picked up the dress April 24, total came to $325 and change. Took dress home and on April 25th took the dress to my seamstress who I have dealing with for quite a few years now. Once my daughter tried on the dress and stepped out for her to alter she noticed that several bead were missing and also the sequences from the gown was missing and some falling off. She refused to alter the dress and upon further investigation she said it appeared that the dress was already worn. I then went back to Chic Boutique and spoke to the clerk in the store she advised me that since I put the dress on layaway that the dress is not refundable nor can you exchange it for another. I showed her the missing bead and sequence and basically was trying to tell me that she was taking it back, I was stuck.
