Ripoff does not honor guarantees lia

David Siebert Studios was hired to take pictures of the students of our kids' dance studio last year. The pictures were delivered extremely late and many parents complained, and many would not have bought pictures from him again.

However, this year he made a guarantee in writing to all the parents that the pictures would be delivered within two weeks this year or he would refund the full amount of the pictures.

Two weeks go by, we still do not have the pictures, nor do any of the other parents. My wife calls and he is supposedly out of town. He calls back a few days later and says he is burning our photo CD right now and will have it out to us in a few days. We wait another week, but still no pictures. I call him this time and he says he is going out of town again, but will put our CD in the mail and we should get it early next week.

We wait another week and again call. He gives excuses such as his only employee quit to work with his father, he was rear-ended yesterday and could not burn the CD (yet it was supposedly burned twice before), but that he was going to burn it today. I tell him we will pick up the pictures and that I want a refund. He says we can get the pictures and he could give us a check but he doesn't have the money right now, but maybe next week. I say fine, we'll take a post-dated check and we'll come to get the pictures tonight.

We get the pictures but he then says he never agreed to giving us a check. Now he says we will have to wait a month possibly to get a check, and says he may end up filing bankruptcy, has too many bills (probably has too many upset parents who want their money back).

Why would someone go out of town when they have a self-imposed deadline to meet, also a photo CD takes minutes to burn - no reason this should have taken over a month and many hoops to jump through.
