On February 19, I entered into an agreement with Realtytrade to sell my time share property. The listing was for 6 months. Both the contract (which I have a copy) and the sales rep clearly indicated in an e mail (which I also have a copy) that if I did not receive any reasonable offers during the 6 month period I would receive a full refund of the listing fee of $1295.

The lowest reasonable fee that was to be offered was $19,200 as amended contractually by me and my wife. After several months of inactivity, I called Realtytrade to inquire as to the status. I was told that I had received an offer. Apparently the offer had been spammed by my computer. How strange. The company indicated that they would send the offer to me again. It was not an offer but the name of an alleged buyer who expressed an interest. I was asked to e mail the buyer directly. I heard nothing back and contacted Realtytrade to advise of this. The rep told me that the buyer had purchased a property at a lower price than mine. Again, how starnge as no price was ever indicated in the inquiry that I received.

An inquiry is NOT an offer to buy. I would have accepted any offer at the bottom range of Realtytrade's definition of reasonable cost. They priced the property and gave me that range. I had no input in that information. Upon the end of the 6 month period, I contacted Realtytrade to get my 100% Money back guarantee. I was told that since I did receive an offer Realtytrade had fulfilled their obligations of the contract and no refund was forthcoming. I advised them that I did NOT receive an "offer" but merely an inquiry that apparently was bogus and probably generated by them in order to not provide the refund. I plan on writing the Attorney General of the State of Florida regarding this matter. This organization should be shut down as they are running a total and complete "scam".
