Sold us an english bulldog with a congenitive disorder and refuses to refund us

We purchased a 7 week old english bulldog pup from this breeder with a contract stating if we had the puppy checked out by a vet within 48 hours and was found to have a congenitive disease that is unable to be corrected at the time of the visit we are entitled to a full refund upon surrender of the dog. The contract also stated common problems, such as cherry eye, elongated palates, or closing of the nostrils was not a covered expense. Upon having our puppy examined by a vet within the 48 hour time frame, he was diagnosed with stenotic nares, a congenetial disease that causes malformation of the nose and airways, thus making it extremely difficult for the dog to breathe through its nose. Our vet said the dog could not be operated until 6-9 months of age, but chances are there are also other congenitive issues the puppy may have but cannot be detected yet due to his age. We immediately contacted the breeder and she said we would meet up the next day to have the dog checked by her vet as well and if the diagnosis was the same, she would issue us our money back. Not to my surprise, within the past hour she has called me back saying she spoke to her lawyer and because it is a problem with his "nostrils", despite the fact our vet advised it is a congenitive disease, she is covered by her "contract" and to not come to the vet tomorrow and to feel free to take her to court. We are going tomorrow to file a claim in the local courts, as the issue is not that his nostrils are not closing. The dog simply has no nostrils and is preventing him from breathing when he does anything short of laying down and not moving. Beware of this breeder and her "contract", as she will give her customers who pay $2000 for a dog a hard time as soon as shes faced with someone who will not accept the fact she sold them a diseased dog. Although she likes to interpret the "contract" she wrote up, typos and all, to her benefit, the fact of the matter remains that the dog has a congenitive disease that cannot be corrected by a vet and she will be forced to refund us our money on this sick dog when shes standing before a judge.
