Refusal to pay freelance photographe

I am a freelance photographer living in Baltimore and shot a job for Dime Magazine in August. The job was below what I am normally paid, $250 flat rate, but I took it anyway to my great regret. Long story short, I have been after the company for months to pay me, and they keep giving me the run around, promising to look into it, to send the check tomorrow, to send the check in Friday's check run, to send the check in 10 days, etc. Etc. It is now March and still no check!

At this point, I am ready to take them to small claims court. I hate the hassle and it is hardly worth it for the money, but this is a matter of principle. I have also contacted Modell's Sporting Goods, who contracted Dime Magazine to have me shoot the photos for an advertorial, to let them know about Dime's unethical practices.

The person I contacted at Modell's called me back right away when I left a voice mail, was very understanding and surprised to hear about Dime's shady practices, and said they would look into it& which is great, because it really isn't their problem at all!
