In April of I went to Moss & Associates to re-file bankruptcy for my husband to stop foreclosure on our home because I have power of attorney over him. He had filed before, but the case was dismissed and they told him he couldn't reinstate his case, he would have to refile. He works construction out of state, so I handle all of his financial obligations.

When I met with attorney J. Steven Huggins ESQ, I explained to him that I wanted to file chapter 13 bankruptcy on behalf of my husband and that I had an true copy of power of attorney over my husband's financial affairs. They still had all my husband's information in the computer because the bankruptcy case had just been dismissed a few months prior. When he looked at the case, he said it would be better if I filed for bankruptcy instead because the Judge would be harder on him for refiling.

I explained to the attorney that I wasn't on the home loan with ASC, only my husband's name was on the loan. He should me several of my husbands case files on his computer that had my signature on them and I explained to him that I do recall signing those documents when my husband refinanced, but that the were solely because I'm his legal wife and they had me sign for the purpose of the deed. Attorney Huggins insisted that I was on the loan and could file chapter 13 bankruptcy for an automatic stay, so I proceeded and did. I made all necessary payments until I received a very disappointing letter from the trustee stating that the mortgage company (ASC) returned the payments sent to them stating that the wouldn't accept the money because I wasn't on the loan. That's what I told the attorney the very first day we met, but he insisted that I was from his records.

I called the trustee and she claimed that there was nothing she could do and that I should contact my attorney at Moss & Associates to discuss the situation. When I called, I would only get the receptionist and all they were concerned with was when I would make my monthly payment, with no regards to the fact that our home was still in foreclosure awaiting a sale date. The only reason I filed for chapter 13 bankruptcy was to save our home, but if the mortgage company wasn't accepting my payments then why am I sending them. I was up to date on my car note, I had payment arrangements up to date with the IRS, so I didn't need to file for bankruptcy, I did it as an attempt to save our home from bankruptcy and took the work of a dishonest attorney.

So, the bankruptcy court dismissed my case for non-payment and now I'll have to keep this bankruptcy on my credit report for 10 years due to misrepresentation and obviously greed. I don't intend on letting this be my only or last option and I hope this will help others who may have been misrepresented by an attorney. Beware!!! Of moss & associates.
