Foreclosed, ruined our credit, Lied about hardship refy

Shops, Products, Services

My husband and I purchased our home in Albuquerque, NM believing we had found our dream home, beautiful, historical, and on a private drive to boot!

Everything went fairly well, although due to our shaky credit, we had to settle for higher interest, and of course a higher payment. This was in October. We bought through a private seller, who then had us refy to a public lender, our first lender was Ocwen, and we had no issues with them... Well no huge issues at least. But late in 2004 we had to refy out from under Ocwen, because this was within the original aggreement with the private sellers. Upon the completion of our refy, we began recieving bills from 2 seperate landers, one being HomeEq Servicing, and the other America's Servicing Company as they had to split the loans. They told us it was because the total amount was too much any one lender to pick up. At first like before, we had no issues, then we began to see charges on both statements from both companies showing up, we would call, they would explain, and we would pay.

Then in Nov. Of my husnabd and I split up for about 2 months, he had no idea about filing for hardship cirrcumstances, and I was out of the state, and had no idea the lenders were threatening my husband with forecloser proceedings. He had moved from our home when payments fell behind and put it on the market. We reconciled in Jan. Of 06, and I began attempting to reconciled our account with the lenders, they both aggreed to recieve a "letter of Hardship" and reveiw our accounts. Well needless to say neither of them reveiwed anything, they simply filed forcloser proceedings, HomEq said at a later time that they never recieved our letter (I sent it out 3 times)
and ASC demanded that we fax our letter to them, which we tried up to 10 times, the gave us 10 different fax numbers citing that we were attempting to send it to the wrong departments. Each time we would attempt to fax this letter to the number they had given us, only minutes prior, it would come up disconnected or wrong number. EVERY TIME!

We then tried to call them back and would be placed on hold, then when actually connected to a human, were treated with extreme rudeness and disrespect.
We finally fealt we no choice then to attempt to file bakrupcy, and were still harrassed by them, and stiss are harrassed by their reps every month. To top it all of, even now after the home has been foreclosed on, they are STILL reporting the the 3 major credit reporting agencies that we owe them the full amount (HomEq is doing the same) and the home has been sold twice since we've let it go!

I have watched the recent "bail out" issues on the news, and all I have to say about that, as far as my husband and I are concerned is TOO LITTLE TOO LATE!

Where were the regulation commitees when these companies were draging us through the preverbial knothole?

Is there a class action suit I should know about? Is it totally too late to make them, make it right?
Who helps us, the real people out here struggling to live, while big banks, and high up exec's line there pockets with our sweat and hard earned money?
