Fraudulent ripoff business

In response to an add I ordered two pairs of slippers and forwarded my personal check to cover the cost. The check was cashed but the slippers have not been received. I called the 514-426-8715 Marvel phone number for three days before it was answered. The customer service representative informed me that the computers were down due to customer service movikng into a larger building. She took my name and phone number and said that someone would return my call and inform me of the order status. Needless to say that I am now waiting for the call in addition to my product. I have also mailed a letter to thje company. Does any one know what is required for a class action suit.
