I joined Enlightened Debt Solutions, Inc. After speaking with a Daryl Rodgers - Credit Advisor at EDSI and from the information given via phone and email, I had a fair understanding that EDSI would help lower my current debt load as several of my accounts became delinquent and the debt to income ratio is very close forcing me to nearly file for bankruptcy. I could not afford the monthly payment associated with a debt management plan so I was enrolled into a debt settlement plan. Daryl Rodgers rushed me through the sign-up process and failed to inform me of all charges (service fees, bank fees, etc.) and said things would go smoothly and that within a couple of months, I would be debt free and the harassing phone calls from credits would stop. After filling out all of the paperwork which took me three times to complete because the customer service department failed to send me the correct papers, I was then turned over to an assigned Customer Service Representative (CSR). My assigned CSR's name was Nadia Walker.

Throughout the time of signing up with this company, I feared that they were not contacting my creditors as described in the contract and the case notes of communication which I demanded for was very limited to say the least. Every time I contacted EDSI, I was asked was creditor I needed to discuss and when papers were send to my creditors and a copy was sent to me in the mail, I noticed that half of the information was not correct and did not actually pertain to that specific creditor. I had to call in and also fax the papers which were incorrect and discuss the information again to the CSR as a reminder and then and only then did they seem to send the correct information out to the appropriate creditors.

I received several letters from creditors along with lawyers asking about payments and since I was informed by EDSI to read from a paper instructing them to call them directly and all would be taken care of, I slacked off a little for soon enough all of the creditors were calling the CSR. When I called and spoke with the CSR, I was advised to not worry about the lawyers demanding and threatening a lawsuit as it would be taken care of. A few weeks later, I received a court notice indicating that I must appear in District Court for a hearing for failure to pay a past due debt.

My hearing was scheduled in June but was told by the CSR to request numerous Continuances to allow them time to contact the creditor and lawyer. I was issued three Continuances and the lawyer requested one, pushing the hearing to 8/5/08 @ 10:30. I went to court not really knowing what to say or do so I contacted the CSR a few days prior asking if there was anything else that I could do, they sent me a list of documents to send to the Plaintiff and Judge to (RESPONSE TO HEARING & DEFENDANTS REQUEST FOR PRODUCTION) and that this would further delay the hearing. I received a call from the Judge informing me that I must appear before the court for the hearing and that no further Continuances would be allowed. I sat before the Plaintiff and Judge telling them my story of woe and was given a judgment for not contacting the lawyer and creditor and failure to pay my past due debt. The lawyer informed me that if EDSI would have contacted them about my financial hardship, that they would have withdrawn from a court hearing and setup a monthly payment plan. I am now left with an even higher debt along with court costs, a judgment against me within the court system and an even poorer credit report score.

While in court, I informed them about EDSI and both the Plaintiff's Lawyer and Judge review the info that I took with me about EDSI (emails, contracts, phone call logs, etc.). They felt that the services offered were not justified and that little work was done for the amount of money paid to EDSI.in just a little over 4 months, I have had $756.00 automatically drafted from my bank account. The judge was quite upset over this information and could not believe an offer was not provided to this creditor, so the judge called ESDI CSR and requested how much money was in the escrow account. They informed the Judge, Plaintiff's Lawyer and I that after fees, etc. Were taken off, the amount of money in the escrow account was only $117 and some change. Further discussion of this in the court room and time reviewed on the companies information, both the Plaintiff's Lawyer and Judge ordered me to cancel the EDSI contract as soon as I left the hearing and request a full refund in the amount of $756.00. Prior to leaving the court room, the Judge asked me to file a claim with the BBB and proceed with legal action if all of the $756.00 was not returned to me. The service fees were not explained well and the amounts of money withheld from the $189.00 monthly payment was not fully disclosed.

I have been attempting to contact Tom Stewart (President of EDSI) since 8/5/08 and have not been able to reach him directly; I have left numerous voice mails and always seem to miss him. I have yet to resolve this issue yet today (8/6).

I should have just filed for bankruptcy and not signed up with EDSI. It is unfortunate that the expectation built with their clients is set so high and that they are actually still in business. I now have learned that they only hire high pressure sales people looking down on innocent people with hardly any money to survive in the country. Please read this a couple times if you need and join me in saying NO to these types of companies. Please avoid this company for all it is going to bring you is a smaller wallet and bank account and more headaches and issues in the long run.
