Deception Used to Attract and Sell 'Samples' to Sales Reps

Final Touch Jewelry, Inc. Found my resume on line and through another 'rep' contacted me with a sales rep opportunity. Extremely high commissions and an exclusive protected territory seemed too good to be true. They said that they had been in business since 1967 and had sold hundreds of accounts. The account list that they provided named many accounts in my territory. They even offered to refund any sample charges and expensed incurred traveling to Dallas for training once I sold $25,000 worth of merchandise to their retailers.
They were very careful to have me sign a 'rep agreement' stating among other things, that there would be no refunds (prior to selling $25,000) on sample purchases.
After paying them $3,000 in a cashier's check (the only check they would accept) I was handed a box of samples.in the box was an assortment of costume jewelry worth, in my opinion, a fraction of what I paid. The prices on each piece were more like retail and certainly not wholesale priced (I had several reputable jewelry distributors verify this). I was even charged for all the felt covered boards ($9.00 each) and three catalogues. When I visited a few stores, I realized immediately that it would be next to impossible to sell anything due to Final Touch's unrealistic pricing. I soon learned that the list of accounts that I was provided contained store names that have been out of business for at least fifteen years.
It is obvious to me that one source of revenue for Final Touch is finding unsuspecting sales reps to sell their overpriced sample line to. Their offer to refund sample charges is well planned as only the most naive and inexperienced buyer would ever place an order. When victimized reps complain, Final Touch labels them as lazy and unwilling to work.
If you've been victimized as I have, I suggest you contact the State of Texas Consumer Protection Division to file a complaint. You can do this easily on line. Maybe if the State of Texas gets enough complaints, they will put a stop to Final Touch's practices.
