Bait and Switch - Advertisng a 10 week as a 5 month to make appear small for age

Vivian's Poodles (and Yorkies) advertised a 3 lb, 5 month old poodle for $600, which was reasonable for a "tiny toy" larger than a teacup and smaller than a toy poodle. The following day I took my new tiny toy for the vet check, and he said, "You have a fine 10 week old poodle here."

After three vet checks within the first two days, there was NO conclusion that this dog was 5 months old, based upon her development (mostly that she still retained her baby teeth). All of Vivian's documentation, including advertisement and registration papers, stated that this puppy was 5 months old. When confronted with the written reports of three doctors, Vivian cried and pled with me to believe her "the breeder" rather than three veterinarians who don't know small dogs like she dogs. I had taken the dog to Vivian's veterinarian who disagreed with her in writing as to this dog's age.

The day following the sale Vivian refused to take the dog back and give a refund of the cash I'd given her. When this dog reached 5 months, she weighed 6 lbs. At 9 months she weighed 6.5 lbs and today she's 7 lbs. Vivian then accused me of over feeding the dog. The dog is not fat, but rather considered healthy by 'Vivian's veterinarian.' I am disabled, 7 lbs doesn't fend for itself and isn't a toy-cup. Even the groomer stated that she was no tea or tiny toy, that she's a healthy toy poodle and he knows dogs.
