In 2004 my husband and I went through a refinancing of our home. It took four months before the signing happened and we ended up having to sign the documents in Sacramento, California because we were on a scheduled vacation.in 2005 my husband and I were forced into bankruptcy. When the current mortgage company filed their claim with the bankruptcy court, part of the documentation that was provided was a copy of our mortgage, of which we had never received a copy of. While reading through the document I found the signature page and realized that these were not our signatures. I then turned the page to see, in the same handwriting, a signature of notary, James M. Cohen, attesting that we had sat before him on April 4 and signed these documents.
Since then we have sued Mr. Cohen in Federal Court and he has been found culpable for his crime.
