I was owed about $1,000 for services I provided in December and January and February. I was a contracted personal trainer with this company.

I moved to Colorado from California in February so I told them not to mail the checks to my California residence. I gave them my Colorado address, and twice they claimed the check got sent back to them (I was getting my other important mail at my new residence with no problem).

I placed several calls and emails regarding the checks, I confirmed my address with them per their request. And they requested that I resubmit my payroll sheets (which have clients' signatures that verified I performed the services they paid for), despite the fact they should already have them on file. The company has a policy to mail out checks on the 1st and 15th of the month regardless of the situation, at the time I thought I would have to wait a few extra days but I was going to get paid.

I got my mail at the beginning of March, didn't get all the money I was owed. I still had a client in Colorado through the same company, I was getting compensated for those sessions, but I never got the money I was owed for January and February. The last week of March I got paid a portion of what I was owed, however I was still owed about half of original amount. I called the payroll department again, and I was told to fax my payroll sheets again, even though I sent them in twice already! It was not a hassle to do, so I sent them in again.

Every beginning and middle of the month, I never got this money I was owed! I kept calling and they kept saying they'll send the check. I stopped training the client I had locally on May 15th, because she was out of sessions. I got all of my compensation for training that client, but never the money I was owed previously.

I kept calling twice a month, I have a full-time day job, so I can't frequently spend my time during business hours trying to get this matter straightened out. This went on for several months with nothing happening. I left a few messages saying how this is unacceptable and I performed this work for the company honestly, so I am entitled to my compensation ASAP. I had a couple of calls that were never returned.

In mid-November, I talked to my manager with the company, and she informed me that they have a new payroll department and I will get paid around November 15th. On November 26th, I called again and the phone number was invalid. I went on the internet to the company's website and found out the company went out of business. I emailed the manager to ask if and when I was going to get my money and she sent me a vague response:

"I do apologize but due to some serious issues we had to close our doors. We have had an employee write fraudulent checks and cash them, several trainers not show up to provide services they were contracted to provide, clients refuse to pay for services rendered, trainers and clients both undercutting our prices and it all combined together crippled our company.
All of us here are left jobless and some even homeless.
I am sorry, but we just can sustain business any longer."

I honestly provided services requested of me, I never did anything against my contract with the company, and my clients prepaid for their services. The company procrastinated sending my paycheck and I was the one who got penalized! I spent my time, gasoline money, and did a lot of driving and never got my compensation for it! I should not have been penalized for moving!
