Ripped me off for $1,300 for apartment on 133rd Street. How can I find them to get my money back?

In April I found an apt on criag's list for an apt which was located at 208 W. 133rd St. I called & made an appt to see the apt. I meet with a "Ms. Jones" & an "old man" at apt on 4/26/07.

There were 2 apts available, 1 on the 1st floor & 1 on the 3rd floor. This apt was for my son, we looked at both apts & said we would be happy with either 1. We paid $125 application fee. On 5/2/07 I met with Ms. Jones & gave her $1,300 (1 months rent & 1 months security) because he was accepted for the apt, we just had the wait for the paperwork to go through the "city".

We waited thoughout May & June. I contineously called Ms. Jones and she lead me to believe it was only a matter of time before the apartment became available. One evening, my son was coming home & seen the "old man" in the ground floor apt showing it to someone else! When he approached him, the man got nervous. The next day Ms. Jones called to inform me that they were just showing that apartment, becuase they had other apartments that were the same size in the building next door, which is 212 W 133rd St.

I called Ms. Jones on 7/5/07 to tell her that my son no longer needed the apt because he had been accepted to another one. She told me to fax a letter to Keisha McDonald and that my money would be refunded within 2 weeks.

I called her for the remaining part of the summer, & it was always 1 excuse after the other. I went to the rental office & someone had broke off a key in the door. Pernell Vassell who Ms. Jones says is the manager, never returns calls & the last time I called the phone was temporarily disconnected!

I received a call from Ms. Jones on 9/20/07 instructing me to call Paul Brennan, a lawyer from them and he would straighten everything out. She was interested to see if I had been to small claims court and that she would work with me to get my money back.

I called Mr. Brennan & he was leaving the office, but he knew about my situation and would call me on monday the 24th. Needless to say he never call back and he finally called & left me a voice mail message yesterday (10/1/07) informing me that he was only a friend of Ms. Jones & that I needed to contact the management company, it was nothing he could do for me.

I when to the PO today to file a MO inquiry. We really need to get together & get these jerks for taking our money! I will be filing a report at the 32nd pct this week & also filing a claim in small claims court. I work too damn hard for my money to allow this people to take advantage of me! Anybody who want to get in contact with me to help find these assholes, please feel free to contact me, because I am going after these people with everything I can! Sombody has got to stop these people, before somebody get hurt bad!
