Homeland Transportation & Delivery
Holding household goods hostage and breaking FMCSA rules ripoff

Shops, Products, Services

Homeland Transportation & Delivery, LLC was subcontracted by a broker I hired to move my household goods.

The owner of Homeland Transportation & Delivery, LLC arrived at my residence representing himself as working for the main company that I contracted.

Homeland Transporation & Delivery, LLC broke the following FMCSA rules:
I was not presented or given a bill of ladening, I was not presented or given an inventory list immediately after my goods were loaded (an email I received stated that there was a verbal agreement that bill of ladening and inventory would be sent electronically, but that verbal agreement never took place), I was not presented or given a copy of the work order to pack and move my goods, I was not presented or given a copy of the insurance policy for the extra insurance I purchased, The mover did not accept his being bound by the brokers estimate, the mover did not adhere to the 110% rule for delivery of goods (he demanded the full amount before even unlocking his truck), the mover did not adhere to the terms of payment aggreed to by the broker.

After finishing packing (at 6am on June 25) the mover told me to go through the house and see if anything had been left behind (this was a partial move). While I was looking through the house and making an inventory of the items that should have been loaded, the mover walked to his truck and drove off. At this point he had not given me a bill of ladening or an inventory list, nor did he have a signature on any document releasing my goods into his care.

The mover emailed me an inventory list 24 hours after he picked up my goods. The inventory list was incomplete (items were on it that were left behind and items were not on it that had been picked up). Upon giving the mover an updated list via email, I was told that he would not open it (he refused to open the updated inventory list).

I received an email from the mover several days later requesting that he be sent money for fuel since his fuel cost was exhorbitant. I ignored his request saying that I had already paid a deposit (over $1500.00) for the move and that the contract stated that nothing else was due until delivery. After that I heard nothing from the mover for several days.

The mover later informed me that he would not be bound by the terms of the original contract and that he must be paid by Western Union money order. Seeing that I might not get my goods back otherwise, I emailed him telling him that I needed 24 hours notice to arrange his payment and be present for the delivery. He agreed to that.

Original pickup date was June 25. It is now July 15 and the mover has failed to show up for delivery stated on his later email to me.

The orginal broker, US van lines of texas, has not been any assistance with this matter.

I have the full email trail for all contacts with the broker and mover.

I have retained a Texas board certified lawyer in the area of consumer contracts and interstate transport to assist with this.

I am only concerned about getting all my household goods that were loaded on that truck returned to me, in the original condition and undamaged.
