Deceptive trade practices ripoff

My name is Fabiano, president on On Time International Corporation, exclusive distributor of PROA swimwear.

We have received an order of US$2991.00 worth of goods on October 21st 2005 to be delivered by March 15th. We shipped the goods on March 10th and delivered on March 13th. (Invoice PR342 - DHL AWB #41490019141).

We have then received two reorders, invoice # PR343 - DHL AWB # 41490011942 - US$US$414.00, delivered April 20th and invoice # PR 344, AWB # 41490345142 - US$206.00, delivered on April 27th. The total amount due then was US$3611.00.

We work on a net 30 terms, but we were required by the customer to extend the first payment due in 30 days, which we did, trusting Island Girl.

On June 2nd, we received a fax signed by Richard and Samantha Schirmer informing that they would not pay for the merchandise because the company was on the verge of
Bankruptcy, which we later found out, was not true according to their bank and credit references provided by Island Girl Beachwear.

We have been lied to, ignored and misled several times by Richard and Samantha during this past 6 months. They have sent us checks for US$500.00, US$600.00, US$206.00, and finally US$414.00, which now give them a balance of US$1891.00.

We are about to file a lawsuit against this company for the total amount due at the small claims court in Laguna Hills, CA.

I have called them personally along with numerous faxes, e-mails and voicemails and none of them received any response from Island Girl. This is extremely stressful, frustrating and humiliating. They keep us giving the run around for payment, even though we continue to send Richard every document required showing clearly the total amount due, which is now US$1891.00. We are only asking for what is fair and legit. We have tried to solve this matter peacefully, but time is up.
