Dear Wendy:

I am having trouble with you adding on. 40 cent per hundred to my cost to ship my automobile plaques to Auburn Indiana. You paid UPS 35 cents for insurance. This would be on $155,000.00/ $542.50 paid to UPS. I paid you $1162.50 for this service, which left you a profit of $620.00 for doing nothing except receiving my money & writing a check to UPS. This is just not right. You should have told me at the time on our phone conversation today October 2,1998 you said that it was implied. I have looked up the word implied in my Blacks Law Dictionary & cannot recall that you implied anything.

I have found out in the fact, you have packaged these crates, that you have to keep records of what you did for me. I want this record now as this has become part of the conflict with UPS and ACDM. I would hope that you would expedite this matter for yours and my sake. It is close to 2 months now since this damage was done & the longer it goes, the more complicated it gets.

I suggest that you let your boss in Seattle know what is going on, as he will be involved in this to. He was in your shop for 2 days when these packages arrived, and should be abel to fill you in, as to what the right thing to do is.

After no answer to my letter of October 3,1998, to Wendy St. Claire (Mail Box Etc. I sent the following letter to her on October 23,1998

Dear Wendy:

Tomorrow it will be 3 weeks since I faxed you my letter with my concerns. You apparently have choose to ignore me in this matter. For whatever reason I don't know. I will be needing this information in the near future and hope you will reconsider as to answering my questions.

One more question. I would like your bosses Address-name & fax number. I would like to discuss this with him.

Implied - this word is used in law as contrasted with "express" i, e where the intention in regard to the subject matter, is not manifested by explicit and direct words, but is gathered by implication or necessary deduction from the circumstances. The general language, or the conduct of the party's.

"This is in Black's Law Dictionary 4th Edition". The following is added to Blacks Law Dictionary 5th Edition.

Terms differs from"inferred" to the extent that he hearer or reader"infers" while the writer or speaker "implies"
With this in mind would you explain that it was something you said that would allow you to charge me over 100%, more on the insurance then you paid UPS?

Mr. Fayette

I understand your frustration with this situation. We no longer hold any responsibility in the matter over your art work. The dispute as to financial reimbursement over damaged materials is between you and the museum.

First i"d like to address your issue with the shipping surcharges. It is important for you to understand that we are a retail shipping center. This means we profit from offering the public an convenient alternative to running around town.

We are a postal convenient store. It is a known fact that we have a mark up on the postal and courier services we offer. It was not our intention to deceive you and i, am, sorry that you felt you were mislead. Our business is not illegal or based on tricking the customer. We simply offer our customer a one stop shop within which they can have there items packaged and sent.

To address your other issue with keeping a record of packaged and unpacked materials in our store. We packaged and sent the art work to the museum. If the packages arrived at the museum in poor condition you would have heard about it immediately for they would not have been put on display. However when unpacking the artwork (by your request) after it was returned, our staff informed you immediately of the damage and requested the investigation by ups. It has been found by there professionals that the art work was sufficiently packaged for the return trip.

Please understand that i have helped you as much as i, can in this matter. I apologizes for what has happened and will continue to work with you in resolving this problem if need be.

Sincerely,

Wendy st. Claire
