Overcharges

I became a dealer @ Brass Armadillo in Phoenix in Dec. 1998. I was quoted $111.00/month for a booth and $69.00/month for a glass case. I paid that until December 1999, when I closed the case.in January they began charging me $111.00 twice each month and then jumped it to $114.30 twice each month. I was hospitalized twice during the first quarter of 2000 and did not notice the overcharging until April. I talked to the Mgr., John Wilson, and he agreed to credit me with the overcharged rent amount but said I would have to vacate the booth. I agreed to move out by the end of April. He charged me two more times after this verbal agreement. I itemized all credits and debits and gave them a copy of it which showed they owed me $349.01. I talked to John the first week of May and asked him if he had my account reconciled and he said "Yes, but I don't know how much it is. Your check will be mailed from the home office." I sent my daughter in to pick it up while I was on vacation and he was very rude to her and said I owed them money. I went to see him today, 05-18-00, and he was rude to me and made several untrue statements. I told him I was quoted $111.00 per month and he said I wasn't quoted that. He was not even there when I opened the booth. I dealt with the assistant mgr. Teresa who no longer works there. I told him I paid the qouted amount for the entire year of 1999 and he said that was not true. Even though I told him I have records to prove it. He said the booth in question was $228.60/month and I should feel lucky that I got it for $111.00 per month for twelve months. He only gave me credit on my last statement for $78.47 which he said was for rent on a case. My records do not show I had a credit coming for the case, we were square on it, but I was overcharged $457.20 on the booth. He refunded none of that and said I was trying to scam him. I told him he could do this the right way or the wrong way and since he was obviously choosing the wrong way, it would cost him much more than the $349.01 that he owes me. He repeated his statement about me scamming him and said that the fact that I had the booth for 13 months at $111.00/month was B& S&. I asked him who his supervisor was and he said "You deal with me" I said "So you own Brass Armadillo?" and he said, "I own enough of it that you have to deal with me". I asked where the home office was and he again said "You deal with me; if you're going to sue, you sue me". I told him that I was going to report him to the Better Business Bureau, the investigative person on Channel 12 News, and Small Claims Court. He said "You're more than welcome to do what ever you want to do and I think it is time for you to leave".
