Equipment Contract ripoff

I am a Dish Network customer and we got our service through Friendly Satellite Systems, 4777 Bennet Dr #D, Livermore, CA 94551, Phone 1-866-718-3474 / 209 839 8100 (Exclusive provider of Dish Network in our community)

Install time, they forced us to sign 2 agreemnts 1) CLUB DISH DHA 12 month Agreement RETCD12DHA 2) Friendly Satellite Systems Terms of Agreement.

The second one looks like a bill for the installation charges, but later when i looked it says you are agreeing to terms on the reverse.

The issue is this. While taking the order, Friendly forced us to take reciever on all rooms telling that up to 4 rooms it is free.in fact we needed only in 2, but they forced us to take a third one.

In the first bill, Dish charged $5 for each room. We called Dish and told about this. They understood the issue and immediately deactivated the service in one room and send us a shipping box to send back the the deactivated reciever.

Later Friendly asked us to reconnect the reciever that was sent to Dish back and threatened to charge $150 to my Credit Card, since we breached the contract with them. I asked them to send me a bill, or asked them to charge to the dish account. They did not listen to any of this, Now after 4 months, i got a collection notice asking to pay 161.0.

I spoke to Dish Customer Service person in detail about this, and according to him The retailer should not charge any thing, as the agreement is with Dish and the installer uses equipment provided by Dish, and we did not breach the DISH contract as we still keep the service in 2 rooms, but DISH network is NOT willing to take any action on this.

Is it legal to have 2 agreements for the same service with diff terms, one with Dish and second with a retailer of Dish? [When we buy cell phone from Amazon and activate thru Cingular we do not sign any agreement with Amazon]

The phone number on the Dishnetwork Agreement (209 839 8100) is different from the number (1-866-718-3474) on the Friendly agreement. Both takes to the same company.

The person whom i talked with (Rosy, dont look like the real name), was very rude and arrogant.
