Collector Demanded $3200 Without Documentation and Threatened Seizure of Property

Dear Sir,

Portfolio Recovery Associates first contacted me by phone on or about November 29. They said I owed them $3200.00, and wanted me to do a check by phone.

They said they were collecting for a Providian account from 1999 and needed to take care of this today. I requested verification of the debt, Original documentation proving I owe Portfolio Recovery for this debt.

They replied, we don't have it and don't need it. Charles, if you don't take care of this today, we are going to take your personal property. The woman I spoke to refused to give me her full name.

She stated I was irresponsible and said my wife was very unlucky to have some one like me. She was reviewing my credit report during our conversation insulting me about my Bankruptcy a few years ago and calling me a slacker.

There were several other insults before I terminated the call. Portfolio stated that they researched me and determined I had assets they could get. Since, they have sent conflicting letters within days of each other.

One letter dated February 21 stating that I now owed them Approx $3800.00 and they would settle for $1900.00 by April 5th. After that I received a Pre legal demand notice threatening me with a local Attorney if they don't hear from me by March 19. I called Portfolio on March 8 and again requested original documentation showing that I owe this money.

Portfolio refused. My complaint is they have bullied me and intimidated me and caused serious health issues for my wife and me.

Portfolio Recovery has not provided valid documentation that they have purchased this debt or contracted with Providian. Further Portfolio is trying to intimidate me in making a payment to them without any legal right. Thank you for taking the time to review my complaint.

P.S. My Wife's health has went down hill since this all started. She suffers from Diabetes and other complications. If I lost her, I don't know what I would do. I spend over $600.00 dollars a month on me and my Wife's Doctor's visits and Medications.

I can't believe the folks at ARA can sleep at night knowing how many people they ripoff. I sincerely would take care of any credit debts that I owe if these Debt Collectors would be honest with me.

In Albuquerque a record number of Law suits have hit Metro court from Portfolio Recovery. Many people have not answered the complaint and Portfolio Recovery Associates has won by default. They two were probably intimidated and harassed. Soon we can rename Albuquerque Metro Court to Portfolio Recovery Court. Portfolio Law Suits will take up the whole Docket.
