Changed type of seating without notice

I would not necessarily describe the following as a ripoff. Misleading and unfair is a better suited description.

I participated in a presale program to purchase Dave Matthews concert tickets for a 6/20/08 show at Nissan Pavillion. When I entered my order I indicated L1 Lower Pavilion seating without the option for secondary seating. On 03/24/08 I was charged 168.25 and confirmed for "L1 Reserved Lower Pav" This is acceptable.

On 04/25/08 the seating assignments were posted for the presale purchases. When I checked the site, I learned my seating was changed to L1 Upper Pavillion. The Warehouse changed the type of seating after my CC had been charged and the type of ticket confirmed. This is not acceptable.in an email exchange on 05/01/08, when I asked why they changed the type of seating, the Warehouse noted: "We corrected the information on the Ticket Status page" In response to a BBB complaint, filed by myself, The Warehouse director admitted a "programming error" with regard to the "type of seating" confirmations. The Warehouse has refused to provide seating as originally confirmed and will only offer a refund. This is the unfair element to this issue. If their website causes an error, and they admit so in writing, they should correct the error in my favor.

The Warehouse knows I cannot get lower pavilion seating via Ticketmaster so offering me a refund is not acceptable - given the fact the artist only comes to town once a year, offering refund would mean missing the show.
