Since our first visit to Bellagio, we have been misinformed on several things. We have been told we had a 30 day period to get out of our lease with no penalty, we were told that a $300 dollar transfer fee would be waived... Both told by leaseing agent and shortly after signing the lease agreement we have found that both of those statements are wrong according to Property Mgr. Her name is TJ. We are moving out of Bellagio. We paid $976 on May 1st and have a written agreement by Property Mgr. TJ to pay a prorated amount once we determine our move out date. I spoke to her yesterday 5/11/09 at 5:50pm and told her I would have that date this afternoon.

This morning a man from the leasing office named Carlos came to our apartment at 8:35am (which I believe to be a violation of FDCPA) and he demanded payment from us or he would have the sheriff's office come and remove our belongings and kick us out. My wife told him we had an arrangement with the Property Mgr. He said he didn't care and that we had to go to the office and pay him today or he would evict us. I went in to the office at 9:15am and asked to speak to TJ... She said she sent Carlos. I asked her why? She said we owe for this month. I told her we had an agreement and that I would pay a pro-rated amount. She said she didnt care and she would not accept our money and was posting a 3day notice on our door, and in a smart way, stated after 9am as not to bother you before then, since I had questioned why this Carlos individual had made a house call before 9am. I believe we have been misled in order to gather maximum funds from my wife and I and have been told things just to get us in.

Once in, none of the items on our work order have been resolved and now the issue with an evistion when I have a written agreement by the Property Mgr and now she is going against that. I need help. I have contacted the local Bar Association and will be setting up a mediation agreement and try to avoid any eviction dealings being place on mine and my wife's credit reports. This is a very important matter and I would appreciate any and all of your help in this unwanted situation.
