In the year 2000 I was getting divorced for the second time and my daughter decided to stay with her step father's family to finish school. I had physical custody and her biological father was on Social Security so I was receiving payments from that department for her child support.

The biological father went to the Social Security office and reported to them that my daughter was now living with him, unbeknownst to me the Social Security office changed the payments to him. He then went to the Friend of the Court and reported that my daughter was living with him and I was ordered to pay child support to him also, he did not report that he was receiving payments from Social Security for her.

It took me two years and an attorney to prove that she did not live with him, I had her school records and her words of what he did to show that she lived with him, such as taking her driver's license and making a copy and changing her address to his on it, but by then she was 18 years old and the support payments stopped.

My questions are: was this legal for him to do? Does he now owe me the support back that I paid? And if he owes me, how do I get this back as he is still on Social Security?

It seems to me he double dipped everyone and she never got a dime of what he received, she always worked and paid her own way while living with her step-family.

If anyone can help I would greatly appreciate it. I know it has been a while and possibly the statutes are now gone but atleast answers would be helpful.
