Miscellaneous

I contracted A.M. Contracting of NY Corp to grind the cement between my exterior bricks (front, side, and rear walls) to a depth of 1/2 inch, top to bottom, and to apply new waterproof cement and waterproof silicone. They also agreed to perform several other tasks on my home. On 8/4 I paid A.M. $1400 of the agreed $5000. They began working days later. On 8/11 I discovered that A.M. Had been grinding bricks to just 1/4 inch, not the 1/2 inch depth promised in the contract, and that they had missed grinding numerous bricks all together. A.M. Also carelessly cut into and damaged the face of more than 50 bricks which must be replaced. Upon examining the section of the wall that A.M. Had already cemented, I discovered the cement was applied very sloppily. The cement lines were very rough, uneven, and varying in color. (I have since learned the varying color was due to inaccurate proportions in mixing the cement). I called Mr. Masnoon, A.M. President, and informed him that the cemented wall and grinding were unsatisfactory, and not what he promised in our contract. He came over and became very difficult. I asked him to clean up the cemented wall before applying any more cement and to grind the remaining bricks more cleanly and to a 1/2 inch depth as promised in my contract. He refused. I told him to honor our contract or refund my $1400. He refused to do either, stopping all work and pulling his men off the job. He returned days later unannounced and began dismantling his scaffolding. I implored him again to simply clean up the cemented wall and to grind the rest of the walls to the promised 1/2 inch depth. He then asked for additional money and a new contract. I called the police and they came to my home. They agreed the wall looked unevenly ground and poorly cemented. The police suggested to Mr. Masnoon that he honor our contract or refund my money. He refused their suggestion, loaded up his truck, and drove off leaving my wall partially ground and partially cemented with numerous damaged bricks. The portion of my wall that was cemented looks horrible and must be done over. I am out $1400 plus the expense of replacing no less than 60 damaged bricks. Mr. Masnoon refuses to take or return my calls.
