I hired Tim Kenney to redesign my website in the spring of 2012. One of the biggest mistakes I've made in my 25 years of business. This project was a train wreck.

After firing him the second time, I asked for a final invoice. I thought it was fair to pay for his time.in his invoice dated April 21st, he charged me more than his proposal stated and at the highest end of the "new" estimated hours. I couldn't understand why the hours were so high when he told me on April 15th that the budget included "any revisions you need" and that he "rarely went over budget." We didn't have any changes for three of the four pieces. (And one of the pieces was regurgitated from my current site.) I asked for a detailed account of the time spent and proposed that we split the difference.

Contacted him three times — no response on the first two. The third time, his assistant/finance said that they weren't deliberately ignoring me and that Tim was busy on another project. She said "we want to spend the appropriate time on a response." She promised that we would hear from her soon. I tried to be understanding but couldn't delay the site any longer, so I moved forward with another designer. I figured that we would settle up when Tim had a break.

Two weeks later, I get this email threatening me with default on the invoice if I don't pay the full amount in 96 hours. And they threatened to charge me an extra $700 in interest when the terms and conditions stated 1.5% interest for overdue invoices. (which was $45 on the amount owed.) Basically, she lied to me and they deliberately ran out the clock so they could threaten me with the default clause in the terms and conditions. I always intended to pay them. The number of hours didn't make sense. I felt bullied and deceived.

I contacted my attorney immediately and he said that I had a right to dispute the hours and that my offer to compromise was reasonable but it would be too expensive to fight. So I paid the bill. And because of his delays, the website files are worthless — again, I had to move on with another designer. I don't expect to ever see my money again. Please learn from my mistake — don't trust this guy!
