Smoking in a non-area

I always go to H.E.B.in Elsa, Tx. And pump gas around between 8:00 pm and 10:00 pm. There is a white guy which is meant to be the security smoking in the area of the gas station. We have notified the cashier and his response was that he was on his break. Which I understand, my concern is that there are signs all over saying No Smoking. Why can't he go smoke in some other area other than an area where he knows he can cause an accident to everyone. His risking everyone that is there at that moment. You never know when something can happen which after things are done are too late. Just concerned, No one is telling him to stop smoking just to find a safer place to do it away from the gas station.
