35 lb. Sentry Safe Dropped Over Gate and Left Damaged

FedEx dropped my new 35 lb. Sentry safe over a 5 foot wrought iron gate onto a cement sidewalk while I watched from an upstairs window. They left the delivery notice without any mention of the drop. The safe was damaged so badly that it would no longer close.

I called FedEx and talked to the deliverer's supervisor, and he apologized. There was never any denial that it happened. I filed a case with FedEx, and they responded by saying I needed to obtain a release of liability from the sender (the sender will not provide this). Instead, he refunded the original cost and filed his own case with FedEx. Since I bought this through an eBay auction, I can't replace it for what I spent. I asked FedEx to replace either the safe or what it would cost to replace it, with no results.

This, to me, is a case of fraud by the deliverer for not leaving notice that he dropped the safe. This all happened before the famous "viral video" came out last month.
