Double billed ripoff Richmond, Virginia Nationwide

I used a Capital One check for a down payment of $4000.00 on a used car. When I received my statement on Aug 12 I immediately transfered to a lower interest rate credit card. This left my balance at Capital One at $0.00. On Aug 14 I was charged another $4000.00 for a special transfer.

When I called they said I would have had to have done it. Well I was at work that day and proved it to them. Kay Smith at the Executive Offices of Capital One admitted I did not owe the 2nd $4000.00. Her Phone # is 1-800-955-1455 x451-6460. She found out that somehow Auto One had made the request. At first she said it was GMAC and they should have sent me a check for the $4000.00. She was very suprised I had not received it.

Now I have been turned in to the credit bureaus an R9. I have sent certified copies of the packet I have kept up with since day 1, included dates, times and people I spoke to. I was getting 2 to 3 calls a day from Cap One. I finally answered one day to tell the person that Kay Smith said I did not owe it. The operator didn't care who said I wasn't responsble and the bill needed to be paid ASAP. She was very rude. So I added them on to my blocked call list.

I have contacted Kay Smith at least 4 times and asked her to mail me something in writing that I did not owe the $4000.00. She even said she would take the finance charges off. Well, I'm still waitng. If anyone is interested in looking at my packet of documents I would be happy to provide it. I have contacted the Better Business Bureau and they don't care. I have contacted the FTC, they don't care. I have contacted by certified mail numerous agencies and they all tell me to hire an attorney. This harrasment is causing me stress, anxiety, and constant worry. Not to mention I can't sleep and I have lost 30 lbs. I know I don't owe it but I can't get any response out of the one person who admitted I do not owe them $4000.00 I have read all the complaints from others and now I have a list of names to start contacting again.
