Miscellaneous

We agreed to purchase a marine transmission fo r $1062.00 plus 400.00 shipping that was advertised as being in GOOD CONDITION / great shape. When we received the transmission it was found to be completly worn out and unusable and about to fail.
When the company was told of the condition they said that I had purchased it "as is". This was not mentioned in the add or in the E-mails until I notified the owner that the transmission was not in GOOD CONDITION.
The owner offered to sell for $400.00, Plus 132.00 shipping a second transmission with the two gears that he described as follows. One gear has a small amount of pitting which is normal and the driven gear has no pitting at all, he sent a photo of two gears - the pitting was not very clear in the photo. I agreed to purchase the parts and when the gears arrived they were both found to be heavily pitted and unusable.
When I contacted the owner again he offered to sell me NEW gears I needed to repair the transmission if I would send him the part numbers and payment for the parts and shipping. He is not willing to replace the defective parts that he described to be good and useable or refund the original purchase price
We contacted the Better Business Bureau and they notified the owner of the company, Steve From Lockhart Machine replied by stating that I had recieved a GoodDeal, but did not address the complaint that he falsely described the condition of both of the transmissions
since I posted the complaint on Rip-Off's web site I have recieved three messages from other unhappy customers claiming to have been treated the same way. Two do not want to file a complaint as the are proceeding with small claims court.
We don't hold out much hope of ever seeing a favorable resolution to this Because we live 3000 miles away from where this company is located.
