Visa Charged $39.99 by Unknown Company, Refund Not Received

$39.99 was charged to my Visa card, and I never ordered anything from them. In fact, I never even heard of them until this happened. I called them and spoke to some foreigner and he said that the funds would be returned. As of 08/23 I haven't received a dime. I guess I am gonna have to file fraud charges against them.
