Warranty Replacement

We bought a Eureka vacum cleaner august 28 for $49.99 along with the 2 year warranty for $9.99. About two weeks ago the vacum started making strang noises and a burning smell was coming from the vacuum. My wife stopped the vacum and checked to see if something had caught in the vacum but there was nothing. This continued for another week so we decided to take it back to xs cargo. A clerk started the vacuum and said there was nothing wrong with it. My wife and i asked her if she could not smell the burning odor, and she finally replied yes she could. She the went and got another lady to come and look at the machine. She removed the canister that collects dust and had a look around the housing and could not find anything wrong with it. She then went and got the store manager named patrick who in turn looked at the vacuum and said that the filter had not been changed causing the smell. He the plugged in the machine without the canister or the filter and ran the vacuum for a few seconds. The burning smell was there. He then said the filter was dirty and was causing the machine to smell. My wife cleans the canister and the filter after every use and washes the filter with hot ware and soap at least once a month. After arguing for at least 15 minutes and asking him why we paid $9.99 for an extended warranty he said we would not get our money back or a replacement which was what we wanted. We took the vacuum and left. I hope you can help us in this matter.
