Cashed my check, didn't ship the product - TI-84 Plus

I have been trying to get a refund from usedcalculators.com for the past several months, from a product returned in October. I ordered and paid for the wrong product, and called to find out how to exchange it. I talked to Mark, who said to return the product with a check (the difference between the products) and they would send out the new product. Months went by, with no reply to my emails. The phone mailbox was full, so messages were impossible to leave. I finally found out they had cashed my check 8 months later, so I started emailing and phoning again. I have now emailed several times, and talked to Mark several times. Each time he promises to look into it, blaming the problem on someone else. How difficult is it to write a check?

I have to assume that they are intentionally defrauding their customers, and would never recommend that anyone buy from them.
