Unfinished and unpaid construction work

We hired conell construction to put an addition on our house and all was going slow but getting done. The trucks hauling away the old dirt from the basement addition destroyed my driveway. Art turned the damage over to his insurance company and the insurance paid him to replace the driveway and even paid over $1000 more than the cost of the drive. After i paid the final installment on our contract (which i knew i shouldn't have) he had one person working alone to finish the job. He had told me they were a few days from being done, but that would be with the normal 2-4 workers and he had 1 worker finish the work which took over 2 weeks and quit work without finishing the job. We (my wife and i) during construction had to pay, in addition to the contracted work, over $700 to replace the leaking patio doors that the contrator had installed. After well over the gauranteed time for the whole job as of this date is far from being complete as there are still several holes in the basement wall and unfinished entrance to the new gameroom. As of this date, 10/22, the basement is not finished. We found out a few days ago that the masonry a (subcontrator) has not beed paid for the work that he did in replacing the driveway from the monies the contractor (Art Conell) received from his insurance. He finally returned my calls and said he had used it to start another job and the last call from Art said he filed for bankruptsy and we would have to file with the court and try to get pennies on the dollar.in my opinion in some ways there is some kind of insurance fraud because the insurance (which i contacted) told me they had paid him directlt the amount of $5711.88 for a bill from the mason of $4250and he never paid the mason a dime
