Freezing in Indiana

Bruce Sebestyen was contracted to build us a new home.in 3 years our ground source HVAC system went out. Bruce subcontracted the HVAC system to Wayne Blevins, owner of Sertech Heating and Cooling of Portland, Indiana. Sertech Heating and Cooling failed to follow the installation manual in violation of the Indiana Building Code causing complete system failure. The installer and general contractor refuse to correct the problem hiding behind each other and pointing fingers so in the mean time my wife and I will be entering our 3rd winter without a heat in Northcentral Indiana. We tried to arbitrate our complaint with the subcontractor but that failed since our contract was with the builder. The builder is currently in the process of having his BBB status changed since he refuses to correct the problem and refuses to arbitrate with us. We are considering legal action but the cost if we loose is significant and we are already out the value of our system at $12,000 so most lawyers suggest just taking the loss. I hate that but if i do, I want others to know. If the problem is small, Bruce might eventually fix it but if it's serious, you can count on NOTHING!
