Rusted out fuel neck

I purchased a used car. When I drove off the lot the gas meter was just about on empty. The first time I filled it up gas came pouring out the bottom leaving a huge puddle of gas. Very obvious something was wrong so headed home as felt very unsafe and situation was dangerous (especially with ti being in the 90"s outside. On the way home the Check engine light came on. Brought it in to a mechanic (it came with a 3 month warranty). It's fuel neck was totally rusted out and had a whole in it. Called the dealer and he said to bring it to his mechanic which I did thinking of coarse he would make good on this. Of coarse I was wrong. While I understand the "as is" rule. Somehow it doesn't seem right that he will get away with this. I now know why it was just about on empty when I bought it. $245.00 dolllars later I am very upset.
