In November, I went into Conviction Fitness to check out the new gym in the neighborhood. It was explained to me that the gym was in the process of getting all of their equipment and would be fully up and running by December 1st. He offered me 1 year membership for $500 and told me that it would start on December 1st, since they would have all of their equipment by then. I signed up, trusting that this new business was not going to deceive the community. December came and went and barely any new equipment arrived, the locker rooms were not finished, and there was no heat or running water. I chalked this up to some minor delays, and continued on.in early January, I started asking when more equipment would be in, and the staff assured me that they would be at "80-90%" by February 1st. February came and no new equipment had arrived and it seemed that no progress was being made. I asked when the equipment would arrive and was told that there had been some delays, and that they would receive some more equipment on March 1st. I told the staff that I needed to talk about cancelling my membership and getting a refund; I was then told to call the owner. I called John, the owner and got no response. I sent 2 emails and finally, on February 3rd, John called me and agreed to refund my credit card $427.72. My membership technically started on 12/1, and it was active for 2 months. This works out to $35.64/month, or $71.28 for the two, resulting in the refund amount. I feel that this is pretty generous on my part, considering that I wasnt getting a full health club experience while I was there.
I kept checking my balance and no refund had been processed, so on February 10th, I emailed to find out if he had processed it. On February 17th, I still had not received a refund or a response, so I emailed again. Later that day, I received a response of I will contact the merchant processor. I never heard back from John and I contacted him again, but havent received a response. I feel like they are just trying to drag this on as long as they can to see if I will give up. I know that I am entitled to a refund, especially since they agreed to it, but it doesnt look like it is coming. Im still waiting for my refund and will not give up until I get it.
