Flood Insurance Check Not Released After Home Damage

My house was in a flood in August of this year and I sent chase a check to endorse and to be return so I can start work on my home and its now november and they refuse to send the check I have to get an attorney and know I will sue for stress i cannot live in the home their is no heat hot water tank its cold and they refuse to release the funds?
