False Advertising and Breech of Contract

Brought a 1993 Wellcraft 287 Prima boat to this business to put it on consignment for sale of 3/14/09. If you look at their website today it has not been updated since 4/23/09 and our boat isn't even listed as one of the boats for sale! Did have one offer for $1749 under the asking price but refused the offer.

Went to see boat on 6/13/09 and was told by owner of the business (Rick) that we had "abondoned" the boat and said he had left a voice mail message on 5/30/09 stating that the boat was now "storage" and it was $25 a day from 5/16/09. No letter sent to us, no certified letter, just a supposed call left on a voice mail! Rick stated that we would have to pay $700 to get our boat back. Absolutely absured! The contract that was signed stated "for a period from 3/14/09 to 12:00 midnight on Owners Notification". NO ENDING DATE! I assume it is his hand writing that he wrote in the "listing also include the following equipment, accessories and items" the one phone call he supposedly made on 5/30/09. No initials from him or us!

Please read their website that states - "What does it cost?" Their answer is "Until we sell your boat, it cost you nothing. After the boat is sold, our usual commission is 10% with a $500 minimum. If your boat is not sold, there are no hidden fees or costs. The Boat Exchange only makes money if we find a buyer for your boat. You may cancel your contract and pickup your boat at any time." So... Does that mean they are false advertising??? Sure seems that way to me! Also while we were there, Rick put his forklift in front of the boat so no one could move it!

This is definately a breech of contract! No where on his contract does it say he will charge storage fees or with a supposed phone call he can change a legal contract! Whatever you do - take it from somebody who knows - DO NOT DO BUSINESS WITH THE BOAT EXCHANGE! They will only try and rip you off like they are trying to do to us!

Filed a complaint with the Better Business Bureau of S.C. Today. Of course you would know they are not members!!!
