Failure to honor their 1 year warranty

Purchased a Gavalia Coffee maker on Ebay which was brand new on 5/18. After making the 8th cup of coffee it started smelling of burnt wires. Since it was purchased under 3rd party they would not honor their warranty. I advised them that according to their enclosed warranty no where does it state anything about third party's. It states that they will honor for 1 year from purchase their product provided it was not abused. This product was not 1 month old. I have a receipt of purchase, and receipt of payment via Paypal. This is a matter of Gavalia and not of Ebay.
