Asked for deposit upfront, then make up ridiculous excuses not to come to work and then disappeared into thin air!

Complaint Description:
I contracted with Mr. Rick Barnhardt of Asphalt, Seal & Stripe Specialists (A.S.S.S.), previously conducting business under the name of Ace's Pavement, located at P.O. Box 2095 Fremont, CA 94536, Tel: 510-395-6128, e-mail: asphaltmonster@pacbell.net to repair my parking lot in Hayward. The scope of the work included: clean, seal, sand & latex the entire parking lot and paint parking lines, Handicap signs and directional arrows. We entered into this contract on 4/17 and work to commence on 4/20 and complete by 4/22/09. Mr. Barnhardt has failed to show up for work citing reasons such as weather too hot to work, workers fallen ill as a result of the extreme heat condition; drizzled yesterday, did not come out to do the work, seal will not stick under wet weather conditions; couple of my workers went back to Mexico because of the swine flu, etc. He has asked and received two payments of $360 & $540 respectively for a total of $900. He has deposited the $540 prematurely, and without my approval. Mr. Barnhardt did not complete the job and each time he failed to show up for the job, he also did not inform us in advance.
