A $1300, non refundable apartment application deposit (scam)

I am still in shock with this one. I filled an application for a 3 bed apt and gave my credit card details same day for the application fee/deposit: $1314 which will count to my first month rent.

My wife, a co applicant called the apt prior to faxing over our application to ask further questions (i went alone the first time) and indicated that she will be visiting to check the apts as well. However, when we did, she felt the size was inadequate.

We viewed 2 other apts but none was especially suitable except one that was almost identical to the one i had seen earlier but on a different floor. (had extra storage under the stairs) The manager offered us new appliances and asked to call in 2 days.

2 days later i got an email indicating that the apt she offered us has been rented out and asked if we would take the former one or any other one we declined earlier. Since we didn' t like any of the options, we asked for a refund of $1314, minus perhaps an application fee that was billed on my credit card.

Instead, i got the mail, that the leasing agreements clearly says that i forfeit all.in reality it does. I admit not reading the application agreement and this was also never mentioned at all by the staff.

The application agreement words it like this"the application deposit is not a security deposit, it will be retained by us as damages if you fail to sign or attempt to withdraw".

I have not signed an actual lease in case any one is wondering.
