My house was sold out from underneath me while in negotiation for a modification

I signed a forbearance agreement in October to save my house. I only entered into the agreement after they made me prove that I had sufficient monthly income to afford my place. I had to make 3 payments up front followed by two normal monthly payments. On the date of the last payment on december 10th they asked me to send in all my forms again asking for a loan modification.

I did that and I kept calling every two weeks to find out my status. They kept telling me I'm in queue to have my situation assigned to a reviewer and they will call me. So I kept calling and finally around the last week in january I received a voice mail saying I was declined. When I called back to find out why and what happened the guy told me I made too much money. I told him this was not possible because in order to get the workout package they offered me I had to show proof that I'd be able to afford the new monthly payments. The guy on the phone said he would have an underwriter call me to go over the numbers. This was the last week in January. He said to call back by January 30th and speak to a supervisor if no one had called.

So I called on Monday Feb 2nd and asked to speak to a supervisor and at first the woman on the phone said, there is nothing we can do you need to resubmit everything from scratch and I told her that was BS and I wanted to speak to a supervisor. She said one was not available so I asked her to email one to call me back.

I didnt hear anything for a week. I called in Monday Feb 9th asking to speak to a supervisor and finally I got some suprvisor to sit and tell me that I was very close to meeting the workout requirements and I told her I just got a raise and I can get a new renter and I should be able to cover the difference. She said, go ahead and submit it. I asked her if I could have until the end of the week to submit. She said, fine, you have time.

They sold my house on Feb 11th without ever mentioning during these calls that the house was going to be sold. I spoke with 3-4 people and no one mentioned this ever. I only entered this workout agreement because they made me show proof of financials showing that I could afford what they were going to offer me. 3% fixed rate with whatever I owed added onto the principal.

When I called in friday the 20th to say I had proof of everything, thats when they told me the house was sold.

There was no new notice of sale. Nothing put on me door. I have no sale docs. I didnt find out until friday the 20th. I know they didnt sell it to a private investor because I ran a title search. I was told that they can rescind the sale. This is what I would like them to do because they did not negotiate with me in good faith. All I received was misinformation.

I received a notice on Feb 21st on my door from Pacifica Financial Services asking me to vacate the premises for $500 by 3/12/09.

Aurora is out to just steal your money.
